TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your use of the MakeMePlayer platform (“MakeMePlayer,” “we,” “our,” or “us”). By accessing or using our platform, you agree to comply with these Terms. Please read them carefully before using MakeMePlayer as a vendor or a user.

MakeMePlayer serves as an aggregator and service provider, allowing vendors to list their programs and users to enroll in various activities and book gym facilities. MakeMePlayer does not own or operate these clubs or vendors and is not responsible for the trainers, institutions, or program providers listed on our platform.

Section 1: General Terms

1.1 Acceptance of Terms:
By accessing or using MakeMePlayer, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. MakeMePlayer reserves the right to modify these Terms at any time. Continued use of the platform after changes indicates acceptance of the revised Terms.

1.2 Use of Platform:

Users and vendors must create an account to access MakeMePlayer’s features.
You agree to provide accurate information and maintain the security of your account.

Section 2: User Policies

2.1 User Cancellation Policy

Users must provide at least 14 days’ notice to cancel a subscription or program enrollment.
Gym facility bookings (e.g., basketball courts, cricket grounds) require a 7-day cancellation notice for a refund.
One-on-one mentoring sessions must be canceled at least 48 hours in advance to be eligible for a refund.

2.2 User Registration Policy

Users may be required to complete a registration form to provide details about themselves and their family members.
Users are responsible for keeping their registration information accurate and up to date.

2.3 Refund Policy for Users

Users are eligible for a full refund if a program or facility booking is canceled by the vendor.
Pro-rated refunds will be issued for canceled classes within a program based on the per-class cost.
Refunds will not be provided for missed classes, no-shows, or cancellations without adhering to required notice periods.

Section 3: Vendor Policies

3.1 Vendor Cancellation Policy

Vendors must provide at least 72 hours’ notice before canceling any program, class, or gym facility booking.
One-on-one mentoring sessions require at least 48 hours’ notice for cancellation.
Vendors must offer either a full refund or a rescheduling option in case of cancellations.

3.2 Listing Policy for Vendors

Vendors must provide accurate information regarding their programs, schedules, pricing, and facilities.
Listings must not contain misleading, obscene, or inappropriate content.
MakeMePlayer reserves the right to modify or remove Listings that violate these Terms.

Section 4: Listing Buying Terms and Conditions

Users may purchase access to programs, gym facilities, or mentoring sessions through MakeMePlayer.
All purchases are subject to vendor availability. MakeMePlayer does not guarantee or take responsibility for the quality or fulfillment of any program.
Users must comply with the vendor’s policies and guidelines after purchasing a listing.

Section 5: Gym Booking Policy

Users can book gym facilities such as basketball courts, cricket grounds, and baseball fields.
A minimum 7-day cancellation notice is required for a full refund.
Vendors are responsible for maintaining accurate availability and promptly notifying users of any changes.

Section 6: Communication Policy

All communication between users and vendors must occur through MakeMePlayer’s messaging system.
Users and vendors must maintain professional and respectful communication at all times.
MakeMePlayer reserves the right to monitor communications and take action against harassment, inappropriate language, or policy violations.

Section 7: Aggregator and Service Provider Role

MakeMePlayer acts solely as an aggregator and service provider.
We facilitate connections between users and vendors but are not responsible for the actions, quality, or performance of any vendor, trainer, institution, or program provider.
Any disputes between users and vendors must be resolved directly. MakeMePlayer may mediate disputes but holds no liability for the outcome.

Section 8: Limitation of Liability

MakeMePlayer shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:

The use or inability to use our platform.
Any interactions between users and vendors.
Loss of data, revenue, or goodwill.

Both users and vendors assume full responsibility for their interactions on the platform.

Section 9: Indemnification

You agree to indemnify, defend, and hold harmless MakeMePlayer, its affiliates, officers, directors, employees, agents, and representatives from any claims, liabilities, damages, losses, costs, expenses, or fees arising from or related to:

Your use of the platform.
Your Listings, content, or conduct.
Any violation of these Terms.

Section 10: Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the province of British Columbia, Canada.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in British Columbia.

Section 11: Miscellaneous

11.1 Entire Agreement:
These Terms constitute the entire agreement between you and MakeMePlayer regarding your use of the platform.

11.2 Severability:
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11.3 No Waiver:
Failure to enforce any provision of these Terms shall not constitute a waiver of such provision or rights.
